Deformed otter penises a concern for humans

Scientists are concerned about the deformed sex organs of England's otters ? and what it might mean for humans.

The furry mammals are found in rivers throughout Britain, but male otters aren't what they used to be. An alarming number of them now have shrunken penis bones (baculum), as well as undescended testicles (cryptorchidism) and cysts on sperm-carrying tubes, according to a new report written by Cardiff University scientists.

The results are based on analyses of samples from 755 otter carcasses collected around England and Wales between 1992 and 2009.

"We were surprised to see the reduction in the baculum weight," Elizabeth Chadwick, project manager at the Cardiff University Otter Project, told the BBC. "(It's) certainly something that needs further investigation."

Though scientists aren't yet able to identify a single cause for the deformed sex organs, one leading suspect is a class of chemical pollutants known as endocrine disruptors.

Endocrine-disrupting chemicals?(EDCs) alter the hormone balance of humans and animals. An unborn fetus is particularly vulnerable to the effects of endocrine disruptors, since the development of sex organs in the womb is largely controlled by hormones such as testosterone and estrogen.

The plastic additive Bisphenol A, or BPA is one hormone disruptor that's consistently been cited as a concern for women of childbearing age and their babies. Other endocrine-disrupting compounds are found in pharmaceuticals, pesticides and other common household products.

Though scientists are still sifting through the evidence, there are many researchers who believe the prevalence of endocrine disruptors might be linked to a worldwide drop in sperm quality and quantity in humans. [Sexy Swimmers: 7 Odd Facts About Sperm]

As the top predator in England's rivers and lakes, the BBC reports, otters are an indicator species whose health reveals much about the well-being of the entire aquatic ecosystem. Health problems discovered in otters, Chadwick said, "could be a warning for all mammals really, which include us humans."

"These findings highlight that it is time to end the complacency about the effects of pollutants on male reproductive health, particularly as some of the effects reported in otters may be caused by the same EDCs that are suspected to contribute to the declining trends in men's reproductive health and cause testicular cancer, undescended testes and low sperm count," Gwynne Lyons, director of Chemicals, Health and Environment Monitoring Trust (CHEM), which co-authored the report with Cardiff University, said in a statement.

HTC One for Sprint spotted with FCC approval

HTC One for Sprint spotted with FCC approval

The HTC One just made its first official appearance (unless you count its brief showing by Peter Chou at the year-end party as "official") on Tuesday, and while we haven't been given any specific availability in the US, its models are at least starting to receive approval from the FCC. This particular model sports Sprint-specific LTE (band 25) and also includes 802.11ac support, a telltale sign that this is indeed the Now Network's One. The fact that the docs detail the test unit as a production model is a solid indication that HTC's flagship is well on its way to Overland Park, and soon. And it doesn't appear to be alone, either; two other variants snuck through the process of federal approval, one with quad-band LTE (bands 2, 4, 5 and 17) and another with dual-band (bands 4 and 17). It seems that HTC isn't wasting any time on bringing its attack to US shores.

G20 defuses talk of "currency war", no accord on debt

MOSCOW (Reuters) - The Group of 20 nations declared on Saturday there would be no 'currency war' and deferred plans to set new debt-cutting targets in an indication of concern about the fragile state of the world economy.

Japan's expansive policies, which have driven down the yen, escaped criticism in a statement thrashed out in Moscow by financial policymakers from the G20, which groups developed and emerging markets and accounts for 90 percent of the world economy.

After late night talks, finance ministers and central bankers agreed on wording closer than expected to a joint statement issued last Tuesday by the Group of Seven rich nations backing market-determined exchange rates.

A draft communique seen by delegates on Friday had steered clear of the G7's call for economic policy not to be targeted at exchange rates. But the final version included a G20 commitment to refrain from competitive devaluations and stated monetary policy would be directed at price stability and growth.

"The language has been strengthened since our discussions last night," Canadian Finance Minister Jim Flaherty told reporters. "It's stronger than it was, but it was quite clear last night that everyone around the table wants to avoid any sort of currency disputes."

The communique did not single out Japan for aggressive monetary and fiscal policies that have seen the yen drop 20 percent, a trend that may now continue.

"The market will take the G20 statement as an approval for what it has been doing -- selling of the yen," said Neil Mellor, currency strategist at Bank of New York Mellon in London. "No censure of Japan means they will be off to the money printing presses."

The statement reflected a substantial, but not complete, endorsement of Tuesday's statement by the G7 nations - the United States, Japan, Britain, Canada, France, Germany and Italy.

"We all agreed on the fact that we refuse to enter any currency war," French Finance Minister Pierre Moscovici told reporters.

NO FISCAL TARGETS

The text also contained a commitment to credible medium-term fiscal strategy, but stopped short of setting specific goals.

A debt-cutting pact struck in Toronto in 2010 will expire this year if leaders fail to agree to extend it at a G20 summit of leaders in St Petersburg in September.

European Economic and Monetary Affairs Commissioner Olli Rehn said he expected concrete debt targets to be agreed at the September meeting.

"We have a common view on the need to have a credible medium-term plans for fiscal consolidation, which is also essential so we have foundation for sustainable growth," he told Reuters.

The United States says it is on track to meet its Toronto pledge but argues that the pace of future fiscal consolidation must not snuff out demand. Germany and others are pressing for another round of binding debt-cutting goals.

Backing in the communique for the use of domestic monetary policy to support economic recovery reflected the U.S. Federal Reserve's commitment to monetary stimulus through quantitative easing, or QE, to promote recovery and jobs.

QE entails large-scale bond buying -- $85 billion a month in the Fed's case -- that helps economic growth but creates money, much of which has leaked into emerging markets, threatening to destabilize them.

That was offset in the communique by a commitment to minimize "negative spillovers" of the resulting financial flows that emerging markets fear may pump up asset bubbles and ruin their export competitiveness.

"Major developed nations (should) pay attention to their monetary policy spillover," Vice Finance Minister Zhu Guangyao was quoted by state news agency Xinhua as saying in Moscow.

"Major developed countries' implementation of excessively relaxed currency policy has an influence on the world economy."

Russia, this year's chair of the G20, said the group had failed to reach agreement on medium-term budget deficit levels and also expressed concern about ultra-loose policies that it and other big emerging economies say could store up trouble for later.

Finance Minister Anton Siluanov said a rebalancing of global growth required more than an adjustment of exchange rates.

"Structural reforms in all countries, either with a positive or negative balance of payments, should play a bigger role," he said in an address to Saturday's talks.

The G20 put together a huge financial backstop to halt a market meltdown in 2009 but has failed to reach those heights since. At successive meetings, Germany has pressed the United States and others to do more to tackle their debts. Washington in turn has urged Berlin to do more to increase demand.

On currencies, the G20 text reiterated its commitment last November, "to move more rapidly toward mores market-determined exchange rate systems and exchange rate flexibility to reflect underlying fundamentals, and avoid persistent exchange rate misalignments".

It said disorderly exchange rate movements and excess volatility in financial flows could harm economic and financial stability.

Exclusive: News Corp, popular tech blog contemplate split - sources

(Reuters) - AllThingsD, the widely read technology blog run by Kara Swisher and Walt Mossberg, has begun discussions with owner News Corp about extending or ending their partnership, sources familiar with the situation told Reuters.

According to these sources, AllThingsD's contract with News Corp expires at the end of the year. One of the sources said Swisher and Mossberg have to deliver a business plan by next week to Robert Thomson, the former Wall Street Journal managing editor who will helm News Corp's publishing unit as CEO after it is spun off.

The fact that AllThingsD's contract is up this year is well known, and sources said the website is receiving a lot of "inbound interest" from potential buyers parallel to its talks with News Corp.

Among the names mentioned as having reached out to AllThingsD were Conde Nast, where Swisher recently signed to work as a contributing writer for Vanity Fair, and Hearst.

Sources also speculated that former Yahoo and News Corp executive Ross Levinsohn might be looking at the website given his new role as Chief Executive of Guggenheim Digital Media, which comes complete with "significant capital to acquire and invest in new media companies." The private equity shop already owns Billboard, Hollywood Reporter, and Adweek.

AllThingsD has reported that AOL expressed interest in acquiring it in the past, but said those talks "were preliminary at best."

Calls to AllThingsD were referred to a News Corp representative who declined comment. A Conde Nast representative declined comment. Calls to Hearst were not immediately returned. Calls and emails to Ross Levinsohn were not returned.

While AllThingsD is recognized as the brainchild of Swisher and Mossberg, News Corp actually owns the website and its name. However, according to provisions in their contract, Swisher and Mossberg have approval authority over any sale, the first source said.

Technically, News Corp could retain the AllThingsD name in the event of a sale, forcing Swisher and Mossberg to start a new venture under a different brand name. But historically in these types of situations a deal is usually worked out to allow the founders to take the company name with them as part of a settlement.

Sources described the website as profitable. It has grown into a technology industry must-read, and features a popular conference division known for snagging A-list corporate executives for intimate interview sessions. Apple's Steve Jobs, Facebook founder Mark Zuckerberg, Microsoft founder Bill Gates, and virtually every other major technology executive has spoken at the D Conference, as it is known.

Earlier this week, AllThingsD's well-regarded media writer, Peter Kafka, led a media-centric conference for the website that included panels with Intel's Eric Huggers, Live Nation CEO Michael Rapino, and Netflix's programming boss Ted Sarandos, among others.

The website has two more conferences on the docket for this year: a mobile one that was postponed until April due to Hurricane Sandy, and the main D Conference in May.

Sources described the relationship between News Corp and AllThingsD as amicable but stressed.

"Like all partnership, there could be more cooperation between the two," said one source. "There is tension between AllThingsD and the Wall Street Journal, for example."

As a result of management changes, over the last few years the website has reported to numerous News Corp executives, among them Gordon Crovitz, Les Hinton, and now Lex Fenwick and Robert Thomson.

Should the two sides reach a deal on a new contract, AllThingsD would be included as part of the publishing unit in the News Corp split.

Tibetan monk sets himself on fire in Nepal

KATMANDU, Nepal (AP) ? A Tibetan monk doused himself with gasoline and set himself on fire in Nepal's capital Wednesday in what is believed to be the latest self-immolation to protest Chinese rule in Tibet.

Police official Keshav Adhikari said the man went inside a cafe, poured gasoline on himself and set himself on fire before police and locals were able to put out the fire and rush him to the hospital.

Adhikari says the man was about 21 years old and has yet to be identified. He is in critical condition and being treated at the Tribhuwan University Teaching Hospital in Katmandu.

Security has been tightened in the area around Boudhanath in the northeastern edge of Katmandu where most of the Tibetan exiles live and home to Buddhist temples and monasteries.

A local eyewitness who did not want to be identified said he saw the monk come out of the cafe, light himself on fire and run a few steps chanting slogans against China before he collapsed on the ground. Police officers and local people were able to put out the fire and send him to hospital.

Thousands of Tibetan exiles live in Nepal and occasionally protest against China. The Nepalese government has banned such protests, saying it cannot allow any activities against any friendly nation to take place in Nepal.

Nepal has allowed thousands of Tibetan exiles to live in the country as refugees, while hundreds more are allowed to pass through Nepal, traveling from Tibet to Dharmasala, India, where their spiritual leader, the Dalai Lama, lives in exile.

Nearly 100 Tibetan monks, nuns and lay people have set themselves on fire in various countries, mostly in ethnic Tibetan areas inside China, since 2009.

Linux Foundation finally gets Microsoft's signature on a secure UEFI boot loader

Whatever hoops the Linux Foundation had to waddle through to get an MS-signed bootloader for use on Windows 8 hardware, it appears to have worked. Whereas Ubuntu and Fedora already had UEFI Secure Boot support, and there was the Shim bootloader and other fixes for smaller distros, this official solution promises to be more user friendly and universal, albeit with a few caveats that are described by MJG59 at the link below. Once you're sure you want it, head over to the source with a USB key and do the honors.

The gigantic debt is crushing our economy by Jennifer Rubin

Somewhat overshadowed by the row about the sequester yesterday were the Congressional Budget Office?s very bleak numbers about anticipated debt and the impact on growth. Economist Douglas Holtz-Eakin and Gordon Gray of the conservative American Action Forum observe, ?CBO?s baseline confirms that the nation, despite claims to the contrary, remains on a damaging debt pathway.? They observe that debt will remain over 90 percent of gross domestic product for the period 2013-2023, resulting in a drag on growth equal to 1 percent per year. That translates into a total loss of 11 million jobs for that period. Moreover, by 2023 Medicare, Medicaid and Social Security will comprise about 64 percent of the budget, ?crowding out other federal priorities.?

The obvious solution is to stop spending so much on entitlement programs. The problem is that the president won?t do that, insisting on raising taxes (a trivial amount compared to the debt but nevertheless another drag on an economy that isn?t growing) or cutting relatively small amounts in discretionary funding (the remaining part of the sequester is less than $1 trillion).

Hashtag Chats, Social Media and India

In a nation where internet peneration is rather low, where teachers tend to stay away from collaborative media and, where connectivity is often patchy - it was wonderful to host the first twitter social media chat with the hashtag #EduIn.? Despite technical glitches, we managed to engage over two hundred people in the space of an hour and make over two and a half lakh impressions (according to the software hashtracker). A small but superb team led by the moderator, discussants and many participants kept the discussion on track. This is a skill that all of us learn as we do more - many here had participated in a hashtag chat for the first time even though many were social media veterans, others were new to the medium.?

    ?

Why am I so thrilled that I share it here with you? I have rarely written a personal post here - though I justify this by saying this is not personal, even as it is written in the first person. It is about being prepared for the future of education. I am thrilled because this is the first time the voice of the concerned citizen was shared on an open platform, and we managed to keep it focused on issues. The discussion was to be on the RTE act, an act that has more vocal detractors than supporters. Even those who support the principle are forced to acknowledge some flaws and gaps in the act and its implementation. There was every danger (and I can safely say that now that it has been averted) that it could turn into a national rant. Rants are not productive. Rants, like trolls like to be fed and move away from key issues, or even hidden issues. We succeeded in that - the conversation was very civil as it was passionate.?

    ?

Though, as I said, many of us were new to the concept of the hashtag chat. Hashtag chats, especially in education have spawned global collaborations for over three years. Teachers have learnt classroom techniques from each other, have shared lesson plans and even found mentors and friends via these chats. These are always moderated, always run by a core team and therefore are focused on the issues of the day. Off topic issues can always be discussed off the hashtag or at different times. It is a learning process to manage the very very rapid pace of the conversation while keeping it on track. Often there are over twenty micro-posts a minute in a normal hashtag chat. To keep pace with this is challenging for the participants and for the moderator. But it is this very pace that manages to bring out a number of aspects in a very short time. Everybody gets a fair chance to have their say.?

    ?

The speed is not the only challenge. It is also dependent on technology. We used the twitter platform that has been reliable for at least three years. This happened to be the one time it crashed globally - something that has not happened in months. When things go wrong, often Indians stick at it.. Another global chat on social media abandoned their chat. We stuck at it, frantically keeping it alive in the first precarious minutes. We lost two major participants but were in full swing in under half an hour. Not just jugaad..it is possible that Indians succeed with grit and staying power too. What amazed us was not just the pace and engagement, but also the huge range of issues that were thrown up. The consensus was also surprising - I had expected (and feared) pitched battles.?

    ?

The other challenge that remains is to ensure that we drive the process of making meaning of collaboration. It is iterative. You need collaboration to break through technophobic barriers so that the contributions are meaningful. At the same time, the design of the collaboration should drive towards meaning. The RTE chat on #EduIn was surprisingly skewed towards concerns on teacher quality despite the wide range of issues thrown up. We need to invest in this process all along the chain for it to yield its multiplier. This is the only way an honest voice gets a fair chance. This is the only way informed policy design gets a chance.?

    ?

And yes, we are going to keep this up. We will continue to support and encourage collaborations online via the open hashtag #EduIn. And we invite contributions, join in. At least once a month.?

NERF Rebelle hands-on: foam arrows and AR for secretly vicious little girls

    NERF Rebelle hands-on

Look, we loved what Mattel did with Lazer Tag last year. But, let's be honest, that thing was pure testosterone. We're not saying the ladies couldn't get down, but the alien-blasting AR solo games weren't exactly designed with little girls in mind. Rebelle ditches the lasers for NERF arrows and slaps a supposedly female-friendly coat of purple and pink paint on the whole thing. While the blasters still operate without the optional Mission Central App cradle ($15), it's once you get the whole kit together that things really start to fall into place. The attachment lets you drop in an iPhone (4, 4S or 5) and fire up the free companion app. (And don't worry Google fans, an Android version of the app along with a universal mount are also in the works.) Rather than focus on solo games and individual competition, the Rebelle Mission Central app encourages kids to form squads and compete not just for supremacy over their friends but also for in-game perks, like accessories for their avatars. Those virtual personas can be completely customized, allowing girls to fully embrace their secret agent fantasies.Of course, you can also document your foam-arrow battles and share them.

The blasters themselves are pretty standard NERF fare and all some basic variation on a crossbow design. The rotating barrel Crossbow ($25) has a pump-action and a rail for installing the cradle, a feature that's not on some of the smaller models like the pocketable, single-shot Sneak Attackers. The other model currently slated for cradle compatibility is the Heartbreaker Bow ($20), which sticks with a more traditional bow and arrow design and has a dash more wickedness to the design than some of the other blasters. The whole Rebelle line is expected to hit shelves in the fall -- so little brothers beware.

Lawyers for Jodi Arias, who could face the death penalty if convicted, argue she acted in self-defense when she killed her lover. He was found in the shower of his?Phoenix?valley home, shot in the face, stabbed 27 times and with his throat slit.

"I just felt ... a little bit, I hate to put it this way, but I felt a little bit used," Arias, a petite, bespectacled woman?with long brown hair, told the court on Wednesday in a calm, measured tone, describing a relationship she said was based around sex.

"He gets a hotel room, I show up, we hang out, we have sex ... He's not really mentally present. I'm getting a lot of attention, but only while we're engaging in sexual activity, and then we check out and he takes off. I kind of felt like a prostitute, sort of," the 32-year-old told the court in testimony that has been relayed widely on news broadcasts and livestreamed on the Internet.

Arias, dressed in a dark jacket and wearing glasses, was taking the stand for a third day on Wednesday at the Maricopa County Superior Court in?Phoenix?where she is on trial accused of murdering 30-year-old?Travis Alexander?in 2008.

Her counsel is arguing she killed Alexander after years of emotional abuse and mistreatment. In her testimony she described a sexual relationship with Travis that was "missing the emotional part, the mental connection, being on the same page."

On the second day of testimony on Tuesday, Arias described meeting Alexander at an insurance convention in?Las Vegas?in fall of 2006, at a time when she was in another relationship.

Describing their first kiss in response to questions from defense attorney?Kirk Nurmi, she said: "He got right in my face, maybe four inches, five," adding, "He licked his lips and said 'I wish you didn't have a boyfriend.'"

Alexander had been dead for five days when he was found with a slit throat, a bullet wound in his head and 27 stab wounds,?the Arizona?Republic?newspaper reported. His death was connected to Arias after sexually explicit photos were found on the memory card of his camera.

She could face the death penalty if convicted of first degree murder. Testimony is continuing.

Critics seek to delay NYC sugary drinks size limit

(AP) ? Opponents are pressing to delay enforcement of the city's novel plan to crack down on supersized, sugary drinks, saying businesses shouldn't have to spend millions of dollars to comply until a court rules on whether the measure is legal.

With the rule set to take effect March 12, beverage industry, restaurant and other business groups have asked a judge to put it on hold at least until there's a ruling on their lawsuit seeking to block it altogether. The measure would bar many eateries from selling high-sugar drinks in cups or containers bigger than 16 ounces.

"It would be a tremendous waste of expense, time, and effort for our members to incur all of the harm and costs associated with the ban if this court decides that the ban is illegal," Chong Sik Le, president of the New York Korean-American Grocers Association, said in court papers filed Friday.

City lawyers are fighting the lawsuit and oppose postponing the restriction, which the city Board of Health approved in September. They said Tuesday they expect to prevail.

"The obesity epidemic kills nearly 6,000 New Yorkers each year. We see no reason to delay the Board of Health's reasonable and legal actions to combat this major, growing problem," Mark Muschenheim, a city attorney, said in a statement.

Another city lawyer, Thomas Merrill, has said officials believe businesses have had enough time to get ready for the new rule. He has noted that the city doesn't plan to seek fines until June.

Mayor Michael Bloomberg and other city officials see the first-of-its-kind limit as a coup for public health. The city's obesity rate is rising, and studies have linked sugary drinks to weight gain, they note.

"This is the biggest step a city has taken to curb obesity," Bloomberg said when the measure passed.

Soda makers and other critics view the rule as an unwarranted intrusion into people's dietary choices and an unfair, uneven burden on business. The restriction won't apply at supermarkets and many convenience stores because the city doesn't regulate them.

While the dispute plays out in court, "the impacted businesses would like some more certainty on when and how they might need to adjust operations," American Beverage Industry spokesman Christopher Gindlesperger said Tuesday.

Those adjustments are expected to cost the association's members about $600,000 in labeling and other expenses for bottles, Vice President Mike Redman said in court papers. Reconfiguring "16-ounce" cups that are actually made slightly bigger, to leave room at the top, is expected to take cup manufacturers three months to a year and cost them anywhere from more than $100,000 to several millions of dollars, Foodservice Packaging Institute President Lynn Dyer said in court documents.

Movie theaters, meanwhile, are concerned because beverages account for more than 20 percent of their overall profits and about 98 percent of soda sales are in containers greater than 16 ounces, according to Robert Sunshine, executive director of the National Association of Theatre Owners of New York State.

Could Your Banking Website Be The Target Of A Lawsuit? | The ...

ADA accessibility litigation is on the rise against financial institutions and other companies. Is your bank or credit union website at risk?

By Douglas Malan, Senior Writer at ZAG Interactive

Your website makes a positive impression on your audience with a professional design, intuitive functionality and valuable content. It may also expose your financial institution to litigation if it?s not fully accessible to people with disabilities.

Federal accessibility laws outlined in the Americans with Disabilities Act historically pertain to wheelchair ramps, doors that open automatically and other features related to brick and mortar spaces. But since 2000, courts throughout the country have ruled that accessibility laws also pertain to a company?s website and have held companies financially liable for difficulties that disabled visitors experience online. Websites that don?t provide proper access to information for deaf or blind visitors, for instance, fall into this category.

?Websites in many ways are becoming the next frontier for ADA litigation,? said Brian G. Muse, a Virginia-based attorney at LeClairRyan who specializes in defending companies against ADA-related lawsuits. ?For the past 10 years, we?ve seen an explosion of these lawsuits. Plaintiffs? attorneys are entitled to recover attorneys? fees in these cases, so it?s very lucrative for lawyers.?

He added, ?This is absolutely something that companies should be concerned about, and they should be proactive about addressing it.?

    Web Content Accessibility Guidelines

The ADA applies to banks, credit unions and other private-sector businesses. If you?ve heard of Section 508 compliance, this section is part of a federal law (Rehabilitation Act of 1973) that was updated in 1998 to require government agencies to make their websites and other electronic information accessible to disabled people. Section 508 does not directly impact private companies.

How does a bank or credit union create a fully accessible website? The World Wide Web Consortium (W3C) produces the widely accepted Web Content Accessibility Guidelines (WCAG) that speak to the proper way information should be presented. The guidelines are now in their second version after an update in 2008 and cover four main principles: Perceivable, Operable, Understandable and Robust.

Here?s a sampling of those guidelines from the WCAG 2.0:

    • Offer a text alternative for every non-text element so it can be changed to large print, braille, speech, symbols or a simpler language
    • Provide alternatives for audio-only and video-only media, including captions and audio descriptions
    • Make it easier for users to see and hear content, including separating foreground from background
    • Make all functionality available from a keyboard
    • Provide users enough time to read and use content
    • Avoid designing content in a way that is known to cause seizures. Web pages should not flash more than three times in any one-second period.
    • Provide ways to help users navigate, find content and determine where they are
    • Make content readable and understandable through different mechanisms
    • Make website pages appear and operate in predictable ways
    • Help users avoid and correct mistakes
    • Maximize compatibility with current and future technologies, including assistive technologies

    The Price of ADA Non-Compliance

ADA compliance is a serious matter that, if unaddressed, exposes your financial institution to litigation and bad publicity. And it doesn?t take a large effort to identify offending websites. Accessibility lawsuits stem from a frustrated user who partnered with a disability rights advocacy group and attorneys to bring the case.

When an accessibility complaint is made against a company?s brick-and-mortar location, there?s a ?future use? legal standard the plaintiff must meet. That means you can?t file an accessibility complaint unless you can prove that you will regularly use that facility in the future, which restricts the pool of potential litigants to a local area.

But there?s no geographic restriction with the internet. A plaintiff using your website in another state could file a lawsuit in that jurisdiction and ?you could end up defending that lawsuit very far from your business,? Muse said, further driving up the cost of litigation.

The major lawsuit regarding website accessibility is National Federation of the Blind v. Target Corporation (2006), a California-based class action lawsuit in which Target paid $6 million to settle claims that its website did not appropriately provide blind people access on its retail website, in violation of the ADA. Target also was ordered to pay $3.7 million in attorneys? fees and costs to the class of plaintiffs.

The list of website accessibility lawsuits grows every year. In 2012, brokerage firm Charles Schwab and video-streaming service Netflix both settled cases rooted in accessibility claims from blind people. But courts disagree about the ADA and whether the law extends to a website or applies only to a brick and mortar location. Netflix, for example, settled the case in Massachusetts but prevailed last year in a California case after the judge ruled based on the brick and mortar logic.

?The law is very unsettled, as we can see from the two different Netflix decisions,? Muse said.

Banks have been defendants in website accessibility lawsuits since 2000 when Bank of America agreed to improve its user experience for blind people as part of a settlement that also included a commitment to installing talking ATMs. Since then, other accessibility claims have been settled by Fleet Bank, Washington Mutual, Sovereign Bank, First Union, Bank One, HSBC and credit reporting agencies Experian, Equifax and TransUnion, among many large corporations in various industries.

?I don?t want to sound like an alarmist, but the point is you need to pay attention to accessibility and perhaps modify your site,? Muse said. ?You do that by getting legal advice from qualified attorneys and by getting technical assistance from industry professionals that can provide proper assistance on achieving compliance.?
